1. Acceptance of Terms

By registering for or using MySMSKart’s Bulk SMS, RCS Business Messaging, WhatsApp Business API or AI Voice Calling services (the “Services”), you agree to these Terms & Conditions. If you do not agree, please do not use the Services.

2. Description of Service

MySMSKart provides a messaging platform that allows businesses to send transactional and promotional messages over SMS, RCS, WhatsApp and AI-driven voice calls, along with related onboarding support such as DLT registration, RCS brand verification and WhatsApp Business API setup.

3. Account Registration & Responsibilities

• You must provide accurate business, contact and billing information at signup and keep it up to date
• You are responsible for maintaining the confidentiality of your account credentials and API keys
• You are responsible for all activity that occurs through your account

4. Acceptable Use Policy

You agree not to use the Services to:

• Send unsolicited, fraudulent, or illegal content, or content that violates TRAI, DLT or any applicable telecom regulation
• Send messages to recipients who have not consented to receive them, where such consent is legally required
• Impersonate any person or entity, or misrepresent your affiliation
• Transmit malware, phishing links, or content that infringes third-party rights

You are solely responsible for ensuring your sender headers, templates and campaigns comply with TRAI DLT regulations and any other applicable law. See our DLT Policy for details.

5. Fees & Payment

Fees for the Services are billed based on your selected plan and usage volume, as communicated at the time of quotation or invoicing. Fees are exclusive of GST unless stated otherwise. Non-payment may result in suspension of Services.

6. Service Availability

We aim to keep our platform available and messages delivered promptly, but delivery depends in part on third-party networks (telecom operators, Meta/WhatsApp, Google RCS infrastructure) that are outside our control. We do not guarantee uninterrupted or error-free service.

7. Intellectual Property

All software, branding and platform content provided by MySMSKart remain our property or that of our licensors. You retain ownership of the content and message templates you submit for delivery through the Services.

8. Limitation of Liability

To the maximum extent permitted by law, MySMSKart shall not be liable for indirect, incidental, or consequential damages arising from use of the Services, including delivery delays or failures caused by third-party networks. Our total liability for any claim shall not exceed the fees paid by you in the three months preceding the claim.

9. Indemnification

You agree to indemnify and hold MySMSKart harmless from claims arising out of your misuse of the Services, violation of these Terms, or violation of applicable law, including DLT and telecom regulations.

10. Termination

Either party may terminate the Services with written notice as agreed at signup. We may suspend or terminate your account immediately if you violate these Terms or applicable law.

11. Governing Law & Jurisdiction

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts at Patna, Bihar.

12. Changes to These Terms

We may update these Terms from time to time. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
